    On the balance of probabilities the respondent's repeated assaults, controlling conduct (including obstructing the petitioner's attempt to work), jealousy and continual quarrels constituted behaviour which, when assessed objectively and then from the petitioner's subjective standpoint, was unreasonable to the petitioner and established an irretrievable breakdown of the marriage; decree granted.

    Having assessed the history of the marriage, the parties' characters and conduct, the court concluded that the respondent's prolonged failure to provide a home or family life, persistent withdrawal and the final breakdown of communication made it unreasonable to expect the petitioner to continue to live with him; accordingly the petition for divorce succeeded and a decree nisi was granted.

    The petitioner failed to prove legal cruelty as there was no evidence of injury or reasonable apprehension of injury and the conduct was not so grave as to render cohabitation virtually impossible; petition dismissed. Nonetheless, under s.46(1)(a) the court exercised jurisdiction to allocate custody preserving the children's welfare: eldest and youngest to petitioner, middle child to respondent, and ordered maintenance of $80/month for the youngest. Costs to be taxed under Legal Aid Regulations.
