The judge found the July and February Summonses were necessary and inevitable given materially changed market circumstances and respondent's defaults and unilateral deductions; respondent's deduction from taxed costs lacked legal basis; stake‑holding was justified to secure enforcement of reserved costs given realistic risk of dissipation; accordingly respondent was ordered to pay costs of the July, February and Stake‑holding Summonses, consent summons to have no order as to costs, and summary assessments were made and directed to be paid from the stake‑held funds.
