At the time the writ was filed the claim combined causes of action founded in statutory tort under the Education Ordinance and sought non-monetary reliefs (injunction/reinstatement) as well as damages, making it a mixed claim excluded from the Labour Tribunal's exclusive jurisdiction; accordingly the High Court retained jurisdiction and the Master's costs order in favour of the Defendant was set aside because the Master erred in principle.
