The five affirmations were irrelevant to the Third Party discovery summons (which had been withdrawn) and represented an improper attempt to introduce background evidence outside the proper procedure; the correct method would have been witness statements and trial evidence. Filing the affirmations in this manner constituted an abuse of process and they must be expunged; costs and a counsel certificate were awarded to the successful applicants (9th and 10th defendants).
