The trafficking conviction was unsafe because the judge misdirected the jury by failing to distinguish storage from trafficking (lack of instruction on the additional intent or joint enterprise element); however possession was established because the jury were satisfied the applicant knew of and controlled the drugs, so the Court quashed the trafficking conviction and under s83A substituted a conviction for possession of the drugs and remanded for sentence.
