The court held that to convict for failure to give driver identification under s.12 Cap.368 the prosecution need only prove proper service of an adequate notice and the defendant's failure to comply; the notice need only refer to the alleged offence; a recorded delivery receipt signed on delivery is prima facie evidence of service under s.8 Cap.1 and, absent contrary proof, establishes service. The magistrate erred in holding otherwise and in treating the existence of the receipt as negating service after earlier finding there was a case to answer.
