Section 30, insofar as it creates presumptions or a requirement that an accused must give an account to the satisfaction of a magistrate (a reverse onus), is inconsistent with Article 11(1) of the Hong Kong Bill of Rights; therefore s 30 was repealed by s 3(2) of the Bill of Rights as from 8 June 1991 and the magistrate was correct to refuse to apply it; appeal dismissed.
