The Court upheld the magistrate's discretionary refusal to award costs because although the prosecution prosecuted on the wrong pleaded complaint, the magistrate found proven statutory breaches that would have led to conviction if properly pleaded, and there was no real prospect of disputing the clear statutory wording, therefore refusing costs was a justified exercise of discretion.
