Although the 1st Defendant's explanation for delay was not fully satisfactory, the proposed amendment was not a surprise to the plaintiff (similar plea by 2nd Defendant in 2021), the plaintiff would have adequate time before trial to address the supplemental statement, and any prejudice could be compensated by costs; accordingly leave to amend and to file the supplemental witness statement was granted, with indemnity costs to the plaintiff for the application and specific directions.
