Section 4(1) requires the court to be satisfied of the relevant circumstances at the time the detention order is made, and s.6A(a) suspends any such order during a sentence of imprisonment of two years or less; therefore the Magistrate could not lawfully make an order to commence after the appellant's prison term and the detention order was revoked and replaced by an alternative sentence of imprisonment.
