Because both the Drug Addiction Treatment Centre and the probation officer reported that the appellant was a drug addict suitable for compulsory treatment and the magistrate gave no reasons for rejecting those recommendations, the appellate court was justified in quashing the imprisonment sentences and substituting a detention order under section 3 of the Drug Addiction Treatment Centres Ordinance.
