The Court held that oral agreements existed in respect of the advertising engagements because plaintiffs performed under the alleged terms, defendants paid invoices and correspondence recognised the engagement; 'subject to contract' wording did not prevent an oral binding agreement on these facts; Mr Miao had authority to bind the defendants; therefore the lower court's awards of damages and contractual interest were affirmed.
