Because the parties did not agree a time for payment the 10% service fee was impliedly payable only on completion of the defendant's services; the defendant withheld delivery of the Receiver before completion and therefore was in breach and not entitled to the service fee or to recover on quantum meruit; plaintiff proved non-delivery of the Outdoor Control and is entitled to judgment for the price paid for the non-delivered items with interest and costs.
