The Master and the court acted within discretion in treating the Defence filed on 14 March 2018 as valid despite potential irregularity because the parties intended the stays to operate continuously until 15 March 2018 and no rule or order imposed an automatic sanction for the filing delay; furthermore the defendants were entitled to draw up sealed orders when the applicant failed to do so and transcript comments do not alter the sealed orders.
