The court was satisfied on the evidence (Law Society investigation, support from other reputable principals, and unsubstantiated complaints by the principal) that the purpose of Form 4 was fulfilled and there was a cogent reason for absence of Form 4; consequently the Rule 13 exemption was granted and the principal's application to intervene was refused because third party intervention in Rule 13 proceedings would be inappropriate and prejudicial in the circumstances.
