Taking the plaintiff's case at its highest for the interlocutory transfer application, the court found a reasonable average multiplicand over the whole period would not exceed HK$5,000 per month and, using the pleaded multiplier of 11, any award for loss of services would not exceed HK$660,000; combined with undisputed bereavement and funeral sums and estimated interest the total was within District Court jurisdiction, therefore the action was transferred to the District Court and costs of the application ordered against the plaintiff.

Sections 20(1) of the Firearms and Ammunition Ordinance and 38(1)(b) of the Immigration Ordinance do not contain words indicating trial on indictment and impose maximum terms within a magistrate's power; under Magistrates Ordinance s88(1) summary-only offences cannot be validly transferred to the District Court unless accompanied by an indictable offence, so the transfer was null, the District Court lacked jurisdiction, and the convictions and sentences must be quashed with jurisdiction remaining in the Magistrates' Court.

Majority held Rule 7(2) was within the Ordinance but the transfer and ensuing District Court hearing did not afford sufficient clarity or evidential basis for the large unliquidated damages award; natural justice required clearer notice of an enlarged claim and fuller inquiry into market value of apprenticeship certificate and consequent loss, therefore the $6,000 award must be set aside and damages remitted for retrial.
