Documentary and affidavit evidence showed the 2nd defendant signed export declarations, acted as importer/consignee, arranged customs clearance, paid customs charges and was reimbursed by Unisun and therefore there was no triable issue that the 2nd defendant participated in exporting/importing counterfeit Adaptec goods; accordingly summary judgment was appropriate and the 2nd defendant was liable for trade mark infringement and passing off; injunctive relief, delivery up and an enquiry as to damages were ordered.
