The court held that in immigration tariff cases governed by So Man King strong humanitarian considerations, including the offender's serious medical condition and life circumstances, can justify departing from the 15-month tariff; on the facts the appellant's disability and background were sufficiently exceptional to reduce the sentences so he could be released and repatriated immediately.
