The magistrate was wrong in principle to suggest a tariff applied to offences of claiming triad membership; after rehearing sentence, a 12-month starting point for each appellant was appropriate given the planned, group claim and threat to livelihood; the 2nd appellant's criminal intimidation sentence had been sufficiently taken into account as an aggravating factor and therefore the two sentences for the 2nd appellant should be served wholly concurrently, resulting in a total of 12 months for each appellant.
