The judge rejected the plaintiff's account, accepted Mr Lau's eyewitness evidence and found the defendant not liable because the facts did not establish that the accident as alleged was caused by the defendant's negligence; accordingly the plaintiff's claim was dismissed. The judge also held that, had the plaintiff's version been accepted, the defendant would have been liable but the plaintiff would have been 15% contributorily negligent and damages quantified accordingly.
