There was a serious question to be tried that the directors approved the disposal of the company's principal business at an undervalue and in breach of fiduciary duties; the court has jurisdiction under s350B and its inherent jurisdiction to grant an interim quia timet injunction to restrain completion pending determination of the application for leave under s168BC (HCMP 841/2013); accordingly an interim injunction was granted and the defendants' strike-out application dismissed.
