The court was satisfied on the evidence that the land was subject to an encumbrance or at least there was doubt as to its existence and that the encumbrancer could not be found despite reasonable enquiries; accordingly payment of $900 into court was directed under s12A and the applicant was permitted to proceed to seek a declaration that the Lots be free from the mortgage after the prescribed notice steps.
