The appellate court found the evidence against D1 and D2 substantial and the convictions not unsafe; D2's application to appeal sentence was out of time and without merit, and the sentence imposed was not manifestly excessive — accordingly both leave applications were dismissed.

Given the appellant's prior immigration convictions, use of different/assumed identities and having received credit for a guilty plea, a nine-month custodial sentence for contravening a Prohibition Order was not excessive and the Magistrate did not err in principle; the appeal is dismissed.

The forgery of the Honduran passport was undisputed, the magistrate permissibly rejected the appellant's explanation based on credibility and surrounding evidence including use of the name LI Wong, the admissibility objection under s.17(a)(1) was not raised at trial and therefore cannot be relied on on appeal, and there was ample evidence to support convictions for possession of a forged document and possession of a false document.

Because the executive prosecution policy changed in November 1990 such that enhanced sentences should not be imposed solely for prior unlawful entries, the court reduced the 18 month sentences to the established norm of 15 months in the appeals before it; where prosecution fell within the stated policy the court reduced sentence but did not order immediate release.

The court held that the branch manager is a person in authority and that an inducement by him could be the causa causans of the 2nd appellant's statements; accordingly the conviction of the 2nd appellant on the obtaining property by deception charge could not be sustained. The other grounds of appeal were rejected.
