The judge did not misapply her discretion: given the wife's needs, the husband's current income/expenditure and incomplete disclosure of resources, an upward variation to $15,000 per month was justified; appellate court will not disturb the exercise of discretion absent error.

The court found there were significant changes in both parties' financial circumstances (reduced husband income, increased child schooling costs and exchange rate, and increased wife income plus undisclosed savings) sufficient to justify a downward variation. The periodical payment was reduced from HK$15,500 to HK$11,000 per month, backdated to 1 February 2007, and any overpayment to be set off against the HK$700,000 lump sum payable on the husband's retirement rather than against future monthly maintenance; no order as to costs.
