Leave to appeal was refused because the trial judge properly assessed credibility, accepted PW1's account that the applicant concealed a box containing two packets of ketamine, and the quantity, packaging, street value and circumstances supported an inference of knowledge and possession for the purpose of trafficking; disclosure of video interviews had been provided and it was for the defence to call those witnesses or rely on the material, so there was no procedural irregularity rendering the conviction unsafe.

The conviction was quashed because the trial judge failed to address a central issue undermining the prosecution case — namely the reliability of an alleged oral admission made before arrest that was not put to the applicant in recorded interviews, was first recorded after the interviews in a notebook produced only at trial, and where there was unexplained delay in cautioning; these defects rendered the conviction unsafe.
