- FACC15/2004
Lord Goddard's formulation remains the applicable test but excludes conduct causing mere inconvenience or trifling additional effort; it does not require proof that the officer's work was made substantially more difficult. On the facts the Magistrate's incorrect treatment of the appellant's failure to complain to the doctor infected his credibility assessment across the single sequence of events, producing substantial and grave injustice; accordingly the obstruction conviction must be quashed.
