The court rejected the defendant's evidence as unreliable, accepted the police witnesses as credible, was satisfied beyond reasonable doubt that no threats, inducement or oppression occurred and that the detention notice and warnings were given and understood, and therefore the video interview and admissions were voluntary and not excluded in the exercise of residual discretion.

The Court held the trial judge did not err in finding the recorded interview voluntary and admissible; there was no material contradiction undermining the investigator's credibility. On sentence review the Court found the original 220-hour community service order was a principled error given the gravity of accepting advantages totalling about HK$1,119,001 and established authorities requiring deterrent sentences for corruption; the service order was quashed and substituted with imprisonment of three years on each count to run concurrently.

The conviction was quashed because the magistrate failed to properly evaluate whether the prosecution proved the essential subjective element (that the appellant knew he was not entitled to vote). The magistrate compounded the error by misapplying an objective test (Ghosh), by failing to give an appropriate credibility direction in relation to the appellant's good character and recorded explanations, and by relying on an unsupported comparison of signatures; these errors rendered the verdict unsafe and unsatisfactory.
