The Court upheld the Tribunal's findings that the implicated persons misused relevant, price sensitive information; the Tribunal properly applied a high civil standard, permissibly drew compelling inferences from phone records and trading patterns, and rightly admitted Harbour Ring evidence to rebut coincidence; section 9 does not require separate proof of causation; financial penalties under s23(1)(c) were set aside in light of HKCFAR authority but otherwise the appeals were dismissed and disqualification/disgorgement orders upheld.
