The court held the applicant's grounds were not reasonably arguable because (a) no general duty existed to inform an applicant during administrative processing of the risk of criminal prosecution arising from independent overstaying, (b) the applicant knew his limit of stay and had appointed Wealth Concepts as agent so correspondence to the agent was reasonable, and (c) the application was fatally delayed; accordingly leave was refused and no extension of time granted.
