The father failed to demonstrate that the proposed private/foreign expert evidence was necessary or sufficiently relevant to justify displacing government clinical psychological assessment; allowing the appointment would cause undue delay and would not be in the children's best interests, therefore both applications for appointment of the Family Separation Clinic are dismissed.

Court granted certificate for three counsel, permitted defendant to pay estimated equitable compensation into court to halt post-judgment interest on agreed terms, and ordered limited post-judgment disclosure of such information as is available and reasonably required to enable the plaintiff to make an informed election between equitable compensation and account of profits; full account-of-profits discovery was refused as oppressive and the court will consider appointing an independent expert to define the necessary scope.

The court preferred the petitioners candidate and appointed him as valuer because the petitioners firm demonstrated greater relevant experience and resources, the respondents candidate disclosed inconsistent and unexplained fee revisions and careless disclosures that undermined confidence in his suitability and independence; consequently the respondents were ordered to pay the petitioners costs incurred after 28 April 2008.

The court directed the appointment of a jointly retained independent accountant (by agreement or court appointment) to value the petitioners' shares as at 15 October 1998 on a net assets basis without a minority discount, with full access to company books and addition of sums misappropriated by the 4th respondent back to company assets; procedural steps and timelines for selection, investigations, auction and completion were ordered and the petitioners were ordered to pay the 3rd respondent's costs to be taxed if not agreed.
