On the admitted facts the deceased was negligent but the driver should have appreciated a real possibility of the deceased stepping into the road (having climbed railings and standing at the pavement edge looking away) and failed to take simple precautions; the trial judge was entitled to apportion liability 50:50 and the damages assessment was supported by the evidence, so the appeal is dismissed.
