HSBC failed to satisfy any of the applicable section 4 Bankruptcy Ordinance jurisdictional limbs: the court found both debtors had acquired Hong Kong as a domicile of choice (since 1993) but had abandoned it (Gregory by January 2020; Bottomley by March 2020) so neither was domiciled in Hong Kong when petitions were presented on 9 May 2024; neither had a place of residence in Hong Kong in the relevant three-year period; and neither carried on a separate personal business in Hong Kong beyond corporate roles. Accordingly the petitions were dismissed and no bankruptcy orders were made.
