The court found HSBC failed to establish any of the section 4 jurisdictional limbs: both debtors had acquired Hong Kong as a domicile of choice but had abandoned it (Gregory in January 2020 and Bottomley in March 2020) so were not domiciled in Hong Kong when the petitions were presented; neither had a place of residence in Hong Kong during the 3 years prior to presentation; and there was no evidence they carried on any separate business in Hong Kong beyond activities attributable to CBM, with article 137 not creating a personal profit.
