On full review the court found material discrepancies, implausibilities and unaddressed issues in the prosecution case such that the prosecution had not proved the offence beyond reasonable doubt; the conviction was therefore unsafe and was quashed.

The Court held the convictions of both applicants were safe and satisfactory: the evidence against the 1st applicant was strong and the jury directions as to police evidence and alleged collusion were adequate for the 2nd applicant; the 1st applicant’s sentence of 8 years was not excessive; leave to appeal was refused.

The Court dismissed the appeals: the trial judge gave adequate directions including a full Turnbull warning and detailed exposition of inconsistencies so there was no fundamental non-direction on collusion; the use of the word 'uncontradicted' did not mislead as it meant not contradicted by the defendant's own testimony; placing full depositions before the jury caused no substantial prejudice and the reference to prior statements as 'evidence' was a harmless slip not amounting to miscarriage of justice.
