On the facts the Court of Appeal upheld the judge’s findings that there was a real possibility the defendant’s assets may be in or pass through Hong Kong (due to use of Hong Kong subsidiaries, proceeds routed via Hong Kong, banking facilities and advisers), and that investigation via examination and resultant commercial leverage constitute legitimate prospective benefits under gateway (m); therefore leave to appeal was refused and the defendant’s summons dismissed.
