Defendants failed to demonstrate a reasonable prospect of success on the proposed grounds of appeal or any other compelling reason in the interests of justice to grant leave; the judge found there was no error in concluding the plaintiff was not obliged to have included the other lots in the 2007 Action and there was insufficient basis to apply Henderson/Henderson-type estoppel against the plaintiff, therefore leave to appeal was refused.
