The court refused to strike out the defendant’s amended defence and counterclaim and refused summary judgment because it was not plain and obvious that the defendant’s case amounted to an abuse of process or was inconsistent with prior proceedings: ownership of the contested items and deposits was not determined in the earlier validity proceedings, the defendant’s explanations were not inherently unbelievable, and the matters require trial; accordingly interlocutory relief was inappropriate and the defence stands to be tried.
