Para.4 of the Fees Regulation must be read as prescribing fees payable for each licence as issued by reference to the type of security work authorised under that particular licence; the items identifying the types of work on the licence do not constitute conditions capable of variation under s.24(1) and the Authority was entitled to grant a new licence in November 1996 rather than vary the July 1996 licence; therefore the Applicant was liable for separate fees and the judicial review application fails.

Where both Regulation 39(1) and Regulation 49(1) are applicable to the same facts, Regulation 39(1) operates to exclude Regulation 49(1) as a matter of law, so both cannot operate in parallel.

The word 'uses' in Section 8 of the Road Traffic Ordinance and Regulation 101 of the Road Traffic (Construction and Use) Regulations includes a driver who drives a vehicle with defective brakes; accordingly the appellant's conviction for using a vehicle with defective brakes is valid and the appeal is dismissed; an owner's liability requires proof of ownership and use, not mere ownership alone.
