On the balance of probabilities the chairperson gave instructions to settle on the 2/3–1/3 basis, but she lacked lawful authority to authorize conversion of common parts because no owners committee resolution under s341I(1)(a) BMO existed; consequently the compromise lacked lawful foundation and the consent order made in reliance upon it must be set aside.
