Once the district judge had recorded and certified the sentences on 8 June 1998 he was functus officio and therefore had no jurisdiction on 12 June 1998 to set aside convictions or sentences; the 12 June order is quashed and a declaration is made that the defendant was properly convicted and sentenced on 8 June.

Because the magistrate's statement indicated he may not have been satisfied as to the Crown expert's qualifications under Section 20 and because the magistrate's recorded findings convicted the defendants of operating a gambling establishment rather than the charged offence of bookmaking, the conviction could not be supported; given the delay and circumstances the court allowed the appeal and remitted the fine rather than ordering a rehearing.

Because the only court order was a Tomlin consent order and no judgment for possession under s.53(2) was entered, the statutory offence under s.53 could not be committed; accordingly the appeal must be allowed and the sentence and consequential order set aside.

Because the case stated lacked any finding that the respondent had taken all reasonable precautions required by s3(2)(a) and the notes of evidence did not supply material justifying amendment, the respondent had not discharged the statutory burden and the appeal must be allowed with the case remitted to the magistrate to enter conviction as to the four tins and impose penalty.
