The court exercised its discretion to admit the psychiatric expert evidence because lay evidence alone was insufficient to determine the true nature, extent, severity and duration of the deceased's stress and its causal link to Takotsubo cardiomyopathy and death; given the early stage, the recommendation of the treating cardiologist, and the fundamental relevance of psychiatric opinion to the s.6 ECO claim, the report was necessary and relevant despite some irrelevant material within it.
