Because the Court of Appeal increased the plaintiff's award beyond the defendants' sanctioned payments, the plaintiff is entitled to the costs of the action at the District Court scale; however, given the circumstances surrounding the defendants' summonses (defendants reasonably relied on sanctioned payments and the plaintiff did not adequately engage to avoid the summonses), it is fair that the parties bear their own costs of those summonses.
