The defendant's incorrect interpretation of the rules and a one-day delay in serving the skeleton argument did not constitute sufficient grounds to order indemnity taxation; accordingly the court refused indemnity costs and allocated costs as stated.

The Registrar erred in law and principle by applying party-and-party style reasonableness and over-relying on outdated Law Society rates when assessing an indemnity taxation; the Court substituted its assessment on key hourly rates and specific time/cost items and ordered a costs outcome reflecting those adjustments (see appendix adjustments) and made an order nisi awarding 70% of the costs of the taxation appeal on an indemnity basis.

Costs were awarded to the plaintiff to be taxed on a party and party basis, including the costs of the hearing, because the plaintiff had to come to court to obtain the orders and there was no justification for indemnity taxation or for ordering solicitors to pay or for reserving costs to a damages enquiry.
