The appellant must bear her own trial costs because she failed to disclose relevant evidence which emerged only in the defence case and that conduct misled the prosecution into proceeding on the more serious charge; however, having succeeded on appeal, the appellant is entitled to costs of the appeal (including the bail pending appeal application).

Because the appellant's conviction was quashed on appeal and the appellant did not invite suspicion or otherwise cause the proceedings, the court awarded him the costs of the trial and the costs of the appeal; if the parties cannot agree the amount, the taxing officer is to assess the costs.

The court found there was no admission by the appellant at the scene and no conduct disentitling him to costs; because the appeal was allowed and nothing justified refusing costs, the appellant was awarded both trial and appeal costs, with assessment by a taxing officer if parties cannot agree.

The Court will entertain a late application for costs in exceptional circumstances but, given the appellant's initial decision not to seek costs and the subsequent change of instructions which caused additional public expense, the appropriate order is to award costs only in respect of the proceedings below and not the costs of the appeal.
