Convictions were quashed because the evidence did not irresistibly support an inference that appellants had entered into an express cross-holding trust at acquisition; the Court of Appeal erred in applying the proviso where only a lawful cross-leasing arrangement and a later 1990 swap of rights to sale proceeds were supported by the evidence.
