On the facts the triangular plot was lawfully treated as part of the Carson Mansion development site because the developer owned it, bona fide proposed to include it in the development and had a realistic prospect of control; reservation for future MTR use did not amount to a dedication that precluded its inclusion, so the Building Authority's refusal of the appellant's plans for exceeding available plot ratio/site coverage was lawful and the appeal is dismissed.
