The court held that the Immigration Department's power to grant permission to enter the United Kingdom and the resulting right of ingress are public/status rights (powers), not proprietary intangible property within the meaning of the Theft Ordinance; therefore attempting by deception to obtain that permission does not constitute an offence under s.17(1) and the charge must be dismissed.
