The Statement of Claim was struck out because a resulting trust cannot be established by mortgage repayments made after the date of purchase absent an allegation of contribution to the purchase price at acquisition, and because the Plaintiff produced no documentary support for its allegation rendering the claim frivolous and an abuse of process; accordingly the action was dismissed and indemnity costs awarded.
