Leave to appeal was refused because the Court concluded there was no reasonable prospect of success: objectively assessed the claimant's discrimination case was so weak as to be frivolous (incidents relied upon related to the project or JV, not the respondent, and other evidence undermined the claim), and the claimant unreasonably rejected a drop-hands offer after full disclosure such that special circumstances under s73E(3)(b) were made out; hence dismissal of the Leave Summons and costs were ordered against the claimant.
