The appeal was dismissed because the ex parte leave application complied with Order 52 Rule 2 and the supporting materials were properly used to give the respondent sufficient particulars; questions of admissibility of evidence are for the substantive hearing; prior determinations by the Court of Appeal were binding and the respondent's repeated allegations of fraud and jurisdictional defects were an abuse amounting to an impermissible attempt to relitigate exhausted matters; accordingly Hartmann J's directions were valid and there was no basis to disqualify him.
